In <strong><a href="http://www.texasforeclosuresforsale.com/homes/TEXAS/DALLAS.html">Dallas</a></strong>, <strong>Texas</strong>, the American Home Mortgage Servicing, Inc. surely is subjected to a big scandal of <strong>foreclosure</strong> fabrication, after FOX 4 gathered some testimonial from some of their mortgage holders.</p>
<p>Some of these testimonials were from people who are certain that they paid their mortgage fee every month yet they still got foreclosure notice, and thus, are on the brink of losing their homes. Some were special cases where they already reached the age when they can defer their property taxes but the company was still demanding that they pay the taxes.</p>
<p>According to these mortgage holders, the firm manages a third account to be able to fabricate their mortgage payments.</p>
<p>What is scarier is that there is no one watching over this firm as they sweep a number of mortgage holders from their houses. The state could not be relied upon, as servicing companies in Texas don’t have to be licensed. In fact, the officers of the Texas Department of Savings and Mortgage Lending are not even regulating this company.</p>
<p>Since even the Commissioner of the said Department is not sure whether they should regulate the company or not, the mortgage holders asked the Texas Attorney General for help. But the number of complaints about every kind of deceptive business grew to an overwhelming number of 35,000 so the Attorney General’s Consumer Protection office complained right away and suggested that the mortgage holders to contact a personal attorney to advise them of their rights as homeowners and as borrowers.</p>
<p>After all of these controversies, FOX 4 asked the American Home Mortgage Servicing, Inc. to respond to the foreclosure issues but the firm declined. The company, however, promised to resolve the issue at hand for the mortgage holders’ satisfaction.</p>
<p>It seems though that the mortgage holders are not satisfied of the firm’s action, if there is any, as they started to file cases against the firm.</p>
<p>Government departments in Texas should now hold the responsibility for these fabricated foreclosures, as the number of victims grow bigger and bigger. An overwhelming number of 35,000 complaints should not serve as a joke for the government, as the number reflects the possibility of a kind of monkey business happening within the said company.</p>

<p>There has been a definite spike in foreclosure figures in the<a href="http://www.texasforeclosuresforsale.com/homes/TEXAS/BEXAR/SAN%20ANTONIO.html"><em> <strong>San Antonio</strong></em></a> area in the past twelve months with no let up at all.  Figures are 3 percent up on the same time last year but experts are at least saying that they don’t see this trend continuing throughout the year.</p>
<p>Previously the focus for <a href="http://www.texasforeclosuresforsale.com/"><em><strong>foreclosures for sale</strong></em></a> have been those people who have defaulted on sub-prime mortgages whose repayments have soared beyond belief, but now it is shifting towards more middle class and middle income families who simply cannot keep up with rising food, water and heating bills.  Wages have remained flat but the bills keep going up and even for the financially reserved folk of San Antonio, they are finding this a real challenge, one that in some cases they cannot meet.</p>
<p>One of the big issues, particularly with middle income earners is that they refuse to see the signs that they cannot meet payments and so they do not go into early negotiation with the banks, feeling that they have failed as a provider.  Once this hurdle has been overcome, the banks are usually keen to go whatever they can to assist as they stand to gain very little by having to go through the foreclosure process.</p>
<p>Lenders basically do not want to foreclose as it adds inventory to their books and effectively reduces the amounts they can loan, which is bad for everyone.  A year ago, the process was more keenly accepted by the lenders and banks, but now they will go to extraordinary lengths to avoid repossession.</p>
<p>San Antonio’s Housing Department is offering free foreclosure workshops for those who are in danger of having their home repossessed.  The City authorities are taking this problem really seriously, establishing a Foreclosure Prevention Task Force.<br />
As many ordinary Americans struggle to make loan repayments, some are profiting off the doom and gloom.  There have been many cases of people running foreclosure scams where properties that have been filed for foreclosure have appeals raised against them and then they are rented out until the ruse is discovered; or even real estate agents that are legitimately making big profits on the resale of foreclosure houses at county courthouses all over the State</p>

<p>The number of <strong><a href="http://www.texasforeclosuresforsale.com/homes/TEXAS/TARRANT/FORT WORTH.html">foreclosures in the  Fort Worth</a></strong> area  has hit record levels according to the Foreclosure Listings Service Inc. (<a href="http://www.flsonline.com/">FSL</a>)  who have been tracking this data nationwide since 1963. Although many commentators are underlining the  fact that the increase for the first quarter of 2009 is only a 3 percent rise  on the same period last year; the numbers are still climbing despite federal  government financial initiatives to assist homeowners and city authorities.</p>
<p>
  More than 13,000 <strong><a href="http://www.texasforeclosuresforsale.com/articles/foreclosures-for-sale/austin-foreclosure-homes/">foreclosure  homes</a></strong> have been listed in the area&rsquo;s courthouses for auction in this first  three month period. The first quarter  does not usually end until 31 March but <strong><a href="http://www.texasforeclosuresforsale.com/articles/foreclosures-for-sale/arlington-foreclosures/">foreclosures</a></strong> have to filed a month  before they hit the auctions, hence the three month period being mentioned in February.</p>

  The scam works like this: once a  foreclosure process is started, an appeal is filed which delays the process by  30 to 60 days, the locks are changed and people are found by the scammers to  move in. Rent is collected until the  ruse is discovered, it really is quite ingenious. An in-depth knowledge of the foreclosure  process is required to pull it off but it is becoming more common in every  neighbourhood. </p>
<p>
  Often foreclosures are associated  with borrowers on low incomes that were subject to sub-prime loan sharks, but  there are more middle class people coming under the scrutiny of the lenders &ndash;  middle income families are also becoming victims and losing their homes. Homeowners are being  encouraged to talk to their banks at the first sign of any financial  difficulty, but it seems that the foreclosures are happening too fast for some  hardworking Americans to stop it.</p>
<p>
  Take the case of Forrest Brannon,  a 78 year old homeowner from <strong><a href="http://www.texasforeclosuresforsale.com/homes/zipcode/TEXAS/DALLAS.html">Dallas</a></strong>. Due to completely unforeseen circumstances  his spending on health care increased unexpectedly and the interest rate on his  adjustable-rate mortgage spiked very fast.  Soon, before he could truly comprehend the impending impact, he was  about to have his home repossessed. This  is not an uncommon story across the State; as it seems the banks are looming  like vultures, ready to prey on the vulnerable.</p>
<p>
  In some State, the foreclosure  process is notoriously long winded, taking up to four month, but at least this  gives borrowers time to renegotiate deals and actually converse with the banks  and lenders; in Texas, the process can take as little as 41 days. According to a Department of Housing and  Community Affairs report published in 2006, this is the fastest in the country.</p>
<p>
  Currently the legislation is so  savage that a borrower only has 20 days to &lsquo;cure&rsquo; a defaulted loan. The Attorney General is in the process of  trying to extend this to 45 days. At  present if the loan is not paid for 20 days then the home can be lost. These laws have been in place since 1984 and  were not even changed after the 1988/89 recession crisis.</p>
<p>
  The trends across the nation  don&rsquo;t necessarily support longer periods to solve the problem. In California,  where the figures are much higher for repossessions and foreclosures, there is  a longer period of grace, yet defaulter numbers are still rising. </p>
<p>
  The <a href="http://www.mbaa.org/">Mortgage Bankers Association</a>  quoted 11.5 percent of sub-prime mortgages across Texas being in some stage of foreclosure,  which is way up on 2007&rsquo;s figure of 9 percent.  The Dallas-Fort Worth area has more than twice the number of sub-prime  problem cases than the whole of <strong><a href="http://www.texasforeclosuresforsale.com/homes/zipcode/TEXAS/HOUSTON.html">Houston</a></strong> and <strong>San Antonio</strong>  combined. For Mr Brannon, his monthly  repayments have increased from $379 to a staggering $700. Mr Brannon had to spend $3000 on dental work  and after that his home became endangered as he received notice of default from  the lender.</p>
<p>
  Not every tale ends badly  however, and after reading about Mr Brannon&rsquo;s case in the newspaper, John  Thurston, a mortgage broker at Acceptance Capital Mortgage Corp. stepped in and  solved the problem, obtaining a reverse mortgage for him from the federal  government&rsquo;s Home Equity Mortgage Conversion programme; not everyone is as  fortunate as Mr Brannon.</p>

One that  springs to mind is the repossession industry.  As unemployment figures rise and <strong>mortgage</strong> defaulters increase, other  areas of people&rsquo;s lives also take a hit. </p>
<p>
  One North   <strong><a href="http://www.texasforeclosuresforsale.com/articles/foreclosures-for-sale/texas-foreclosure-homes-for-sale/">Texas</a></strong> based company is in the business of repossessing cars when  <strong>loan</strong> repayments are not maintained, and their business has increased six times  more than the same month last year.  Jeff, who has been in the business for 11 years, says that it is a real  shame that what he does brings unhappiness to people, but if they cannot keep  up their payments, then they cannot keep the vehicle. He cruises a neighbourhood looking for an old  <a href="http://www.bmw.com/">BMW</a>, he finds it and within 19 seconds it is on the back of his truck. He has been shot and stabbed twice in the  course of his work &ndash; this is the state of the economy at present.</p>
<p>
  Usually it is possible to cope  with the loss of your car, you can try to get to work in a car-share with a  colleague, or take the bus &ndash; but losing your home is a different story  altogether. <strong><a href="http://www.texasforeclosuresforsale.com/articles/foreclosures-for-sale/austin-foreclosure-homes/">Foreclosure</a></strong> filings are up 3  percent this month, in comparison to the same month a year ago. This is being heralded as a triumph &ndash; only up  3 percent, perhaps the rate of doom is slowing?  But it is still a rise of 3 percent which makes the level a record, so  it is clearly still bad news.</p>

  One 78 year old <strong><a href="http://www.texasforeclosuresforsale.com/homes/TEXAS/DALLAS/DALLAS.html">Dallas</a></strong> resident failed to meet his mortgage  repayments after he had to pay out $3,000 of unexpected dental fees. His mortgage repayments spiked from $389 a  month to over $700 and he was about to lose his home.</p>
<p>
  Mr Forest Brannon&rsquo;s story was  published in the press and luckily for him an interested Mortgage Broker  decided to take his case on. He managed  to get Mr Brannon a reverse mortgage as part of a federal government initiative  so that his home has been saved. Not  everyone is this fortunate, and the pace that Texas foreclosures can happen is faster than  anywhere else in the county.  Foreclosures can be initiated only 20 days after the first default,  whereas in most other States it is as much as 45 days; an issue that the  Attorney General is currently grappling with.</p>

In Houston  alone there are currently 11,246 properties listed, with an average price of  $116,778.</p>

<p>Figures released from the  <a href="http://www.texasforeclosuresforsale.com/"><strong>Foreclosure Listing Service (FLS)</strong></a>, based in Addison  say that the bidders at 2006 auctions were paying 73 cents on the dollar.  Deals went better in 2007, creeping down to  66 cents and last year’s average was right down to 59 cents.</p>
<p>Third party purchases were  actually down last year at 884 compared to 1,044 the previous year for the D-FW  area, this is a drop of 15 percent.  With  the economic conditions worsening there have been fewer purchases according to  FLS.</p>
<p>With more properties coming on to  the foreclosure listings, the prediction is for the number of third party  purchases to go up significantly over the next few months.  Texas has one of the shortest defaulter grace periods in the country, with lenders able to start foreclosure proceedings just 21 days after the notice is given –  in many other States, the normal timeline is 45 days.  The Attorney General is currently working on  extending the time in Texas.</p>
<p>As for property values well the  average assessed property price at auction was set at $206,098 with the average  bid at around $137,735.  This is a good  deal above the D-FW area whose bids were much lower at $99,254.</p>
<p>There is a warning for those not  too experienced at this process; many of the buyers are professional retail  real estate veterans and not private buyers looking to make a quick buck.  A substantial number of the properties  available for auction are bought unseen and in poor condition requiring many  thousands of dollars to make them inhabitable.   For the larger real estate agents they have good deals with local  builders as they give them a lot of work; for a private buyer, it could prove  costly when you actually get to see what you have bought.</p>
<p>Some disenfranchised homeowners  who have been thrown out of their homes have completely stripped them bare,  right down to the fixtures, fittings and floorboards, so beware.  One thing is fairly certain in this game  though, the number of foreclosures is still rising, and so the number of  properties at the auctions is increasing too; there will be more bargains, but  will there be the third party buyers for them?</p>

Currently the Executive Inn is the premier hotel in the area for leisure, business and conventions.</p>

<p>Unemployment trends across the county have made for disturbing reading as they continue to rise, currently sat at around 7.5 percent, this is way too high to be sustainable.  In such a small county, either more people will be made homeless, or more people will have to travel further to find work, neither of which is what the local population wants.  Maintenance of the community spirit and the ability to continue to work and support their families is all that the people of Houston County really want.</p>
<p>Despite the recent announcements of hundreds of billions of dollars being granted by the federal government to kick start the economy and the talk of Neighbourhood Stabilization Programs; the folk in Houston County are under no illusions, they will be left to fend for themselves whilst the aid is directed towards the worst hit areas such as California and Nevada. <p>This is not a common phenomenon however, and only 900 such deals were recorded in the Dallas-Fort Worth area in the whole of last year.  This only amount to around 4 percent of foreclosure property purchases in the four county area.</p>
<p>The discounts available for those that are risk-happy enough to buy directly can be as much as 11 percent, according to Foreclosure Listing Service President George Roddy.  Each month these kinds of property auctions occur, and in 2008, third party buyers were snapping up foreclosed homes for as little as $99,245 (as an average) compared to the average retail value of the same properties being up at $162,251.</p>
<p>The pragmatics of buying these properties at such an auction prevents many from thinking about it; you need to be able to pay the vendor immediately and most payments are with a cashier’s cheque so there is a lot of research done about each property prior to a bid.</p>
<p>Across the State as a whole, almost 6.5 percent of mortgage holders are behind on their payments.  This may come as a shock to many, but it is still way behind Arizona and California who have been leading the ratings for some time now.</p>
<p>North Texas is certainly the worst hit across the State, according the RealtyTrac, the State is ranked 11th worst hit in the country.  RealtyTrac are also reporting that nationwide figures are down from December; a much anticipated announcement that many are citing is as a result of federal government bail out plans now taking effect.  The one certainty is that everyone is hoping the trend continues.</p>
<p>For many, the problem is not only the prospect of foreclosure, but the prospect of unemployment.  Householders all over the State have lived with a philosophy that has made America what it is today; work hard and you will enjoy the fruits of your labour.
